1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our Application.

You are responsible for safeguarding the password that you use to access the Application and for any activities or actions under your password.

2. Intellectual Property and User Content

Our Application allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content"). You are responsible for the Content that you post to the Application, including its legality, reliability, and appropriateness.

By posting Content to the Application, you grant us the right and license to use, modify, publicly perform, publicly display, reproduce, and distribute such Content on and through the Application. You retain any and all of your rights to any Content you submit, post or display on or through the Application and you are responsible for protecting those rights.

The Application and its original content (excluding Content provided by users), features, and functionality are and will remain the exclusive property of SECOND WIND LIMITED and its licensors.

3. Prohibited Uses

You may use the Application only for lawful purposes and in accordance with Terms. You agree not to use the Application:

• In any way that violates any applicable national or international law or regulation.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors in any way.
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail", "chain letter," "spam," or any other similar solicitation.
• To impersonate or attempt to impersonate SECOND WIND LIMITED, a SECOND WIND LIMITED employee, another user, or any other person or entity.
• To post any content that is offensive, hateful, discriminatory, or infringes on the intellectual property rights of others.

4. In-App Purchases and Subscriptions

The Application may offer in-app purchases or subscriptions ("Purchases"). If you wish to make a Purchase, you may be asked to supply certain information relevant to your Purchase.

All Purchases are processed through the respective app store (Apple App Store or Google Play Store) and are subject to their terms and conditions. We reserve the right to refuse or cancel your order at any time for certain reasons including but not limited to: product or service availability, errors in the description or price of the product or service, or error in your order.

5. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Application will immediately cease.

6. Limitation of Liability

In no event shall SECOND WIND LIMITED, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Application.

7. Disclaimer

Your use of the Application is at your sole risk. The Application is provided on an "AS IS" and "AS AVAILABLE" basis. The Application is provided without warranties of any kind, whether express or implied.

8. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Application after those revisions become effective, you agree to be bound by the revised terms.
